Terms and Conditions

Enrolmy helps organisations promote and run activities, and helps families find and book them.
These terms set out how Enrolmy works and what we can each expect from one another.

Which terms apply to you?

We have one set of terms for families and people booking activities, and one for activity providers. Please choose the one that applies to you to see the full terms. If you use Enrolmy both as a provider and as a parent, each set applies to that use.

If you have any questions, please get in touch through our Contact us page.

Terms for Parents and people making bookings

These terms apply when you use Enrolmy to browse activities, hold a family account, or make a booking, including on behalf of a child in your care. Our privacy policy explains how we handle personal information. It sits alongside these terms rather than forming a separate contract.

1. Who we are

In these terms, "Enrolmy", "we", "us" and "our" refer to the Enrolmy company for your region, as shown below. "Website" means enrolmy.com, including its regional sites. "Platform" means our website, the Enrolmy mobile app, and the services we provide through them.

United StatesEnrolmy UK & EU LimitedSee "Information for your region". US consumer rights are preserved.
SingaporeEnrolmy LimitedSee "Information for your region"
CanadaEnrolmy UK & EU LimitedSee "Information for your region"

Where a provision in "Information for your region", at the end of these terms, differs from the rest of these terms, that regional provision applies to people in that region.

2. What Enrolmy does

Enrolmy is a platform for helping Parents and Caregivers to find and book activities. Providers use it to promote and manage their activities and take your bookings and payments.

The provider is responsible for running the activity, including the programme, venue, staff, the care of children, and pricing. Enrolmy does not deliver activities, and making a booking does not make us the childcare provider, school, club or coach.

3. Agreeing to these terms, and changes

You agree to these terms by confirming your acceptance in the platform, for example by ticking the box when we ask you to. We ask you to do this when you create an account or make a booking.

We may update these terms from time to time. When we do, the platform will prompt you to confirm the updated terms electronically the next time you use Enrolmy. The updated terms apply once you have confirmed.

If you do not wish to accept the updated terms, you can choose not to use Enrolmy. Any rights that already exist, such as a booking you hold with a provider, are not affected.

4. Your account

You must be 18 or over to hold an Enrolmy account.

You must keep your password confidential and let us know promptly if you believe someone else has used your account. You are responsible for activity on your account until you tell us.

Please make sure the information you give us is accurate and kept up to date.

5. Finding and booking activities

You are welcome to use the platform to browse activities and make bookings with providers.

Each listing is the provider's own description of their activity. Before booking, please check the details carefully, including the dates, price and the provider's terms.

6. Your booking is with the provider

When you make a booking, your agreement is with the provider rather than with Enrolmy. Each provider sets out their own terms on their booking pages, and those terms apply to your booking. The provider decides whether to accept the booking and is responsible for delivering the activity.

We review providers when they join Enrolmy. That review does not mean we run the activity or employ the provider's staff, and we cannot guarantee that an activity will suit your child or go ahead as planned.

The provider is responsible for safety during the activity, including supervision, staffing, qualifications, and any police or vetting checks their work requires.

7. Paying for an activity

You pay the provider for the activity, at the price and on the terms they set out.

Providers usually invoice you through Enrolmy. Your invoice will show the amount due and the options for payment. All payments by card, bank account or otherwise are processed by a certified payment provider. Enrolmy itself does not retain your credit card details. These are stored securely by the payment processor. A saved payment method may be used only if you permit it, and only for payments you have authorised for bookings with that provider.

Any subsidy or funding arrangement is between you and the provider, or between you and the funding body. We do not manage these arrangements on your behalf unless the platform indicates that we do for that provider.

8. Cancellations, refunds and concerns

Your booking is subject to the provider's cancellation and refund policy, so please read it before you book. If you wish to cancel or change a booking, or have a question about a charge, please contact the provider.

If you have raised the matter with the provider and it remains unresolved, you may contact us. We will review what happened on the platform and help you and the provider communicate. Although your contract is with the provider of the activity, we will provide best-efforts assistance to help resolve disputes between you and the provider. We do not decide whether an activity was delivered as promised, and we do not refund provider fees ourselves.

Nothing in this section affects your rights under the consumer law described in "Information for your region", including any rights you have against the provider.

9. Information about you and your child

You are responsible for the information you provide. It should be accurate, and you must have the right to share it.

When you add a child or another person, you confirm that you are their parent or guardian, or are otherwise authorised to provide their information and accept these terms on their behalf.

Providers can see the booking information they need to run their activity. This may include health information you choose to share, such as allergies, medical conditions, dietary needs or additional support requirements, so the provider can care for the participant. The provider is responsible for the booking information they ask you for, and we store and process it on their behalf. Our privacy policy explains how this information is used, and your rights to manage and remove your data.

Your information remains yours. You give us a licence to store, copy and use it for as long as we need to in order to facilitate your account, pass your booking to the provider, and meet our legal obligations and the legal obligations of our providers. We may also include it in anonymised, combined statistics that do not identify you or your child.

10. Using Enrolmy responsibly

Enrolmy is designed for finding and booking activities. Please use it only for that purpose.

You must not:

  • copy, modify or reverse engineer the platform
  • interfere with the platform or its security, or attempt to access data you are not authorised to see
  • use the platform in any way that breaks the law
  • upload anything unlawful, indecent, threatening or offensive, anything that infringes another person's rights, or any virus or other harmful code
  • impersonate another person
  • use the platform for gambling or gaming of any kind

We may remove any content that does not comply with these terms.

You may use the Enrolmy mobile app while your account remains open. The app forms part of the platform, and these terms apply to it. The app store you download it from may also have its own terms.

11. The platform

We use considerable efforts to keep the platform available, but we cannot promise uninterrupted service. You will need a reliable internet connection to use it.

We are always working to improve Enrolmy, so features may change over time, and occasionally a feature may be withdrawn. We make every effort to minimise the impact of changes and, where we can, introduce them with options so you can choose what works best for you. Sometimes, however, a change is needed. If a change does not work for you, please let us know. You can also stop using Enrolmy at any time.

You retain ownership of your data, but all intellectual property in the Enrolmy platform, including the website, the mobile app, our software, our branding and our documentation, remains with Enrolmy.

12. Liability

This section explains what we are, and are not, responsible for, so please read it carefully.

The activity. Enrolmy is not responsible for running the activity, safety at the venue, staff, the care of children, and the fees providers charge.

The platform. We provide the platform with reasonable care and skill, but we cannot guarantee that it will be free of errors or always available. We use considerable efforts to keep your information secure, although no internet transmission is completely secure. We are not liable for loss caused by a failure of the public internet or of your own equipment.

Limits. As far as the law allows, we are not liable for loss of profit, loss of business, or any other indirect or consequential loss arising from your use of the platform.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded under the law that applies to you. Consumer rights that cannot be waived are described in "Information for your region" and are not affected.

These limits also apply to our directors, staff and contractors.

13. Responsibility for loss you cause

You agree to cover reasonable losses, costs and claims we incur because you have breached these terms or misused the platform or another person's account. This applies only to loss that results from that conduct, and it does not extend to loss that we cause ourselves.

14. Closing your account

You can close your account at any time through our Contact us page, or by using a close-account option in the product where one is available. If you ask us in writing, we will close your account within one month.

Closing your Enrolmy account does not cancel any existing booking with a provider, or any money owing to the provider. Please contact the provider directly about any bookings that are still current.

We may close your account by giving 15 days' written notice. We may also suspend or close it immediately if you seriously breach these terms, or breach them and do not put things right within a reasonable time after we ask you to, or if you do something that causes serious harm to the platform or to our reputation. We will not do this in a way that interferes with a booking you have already made, which remains with the provider.

Once your account is closed, we will delete or de-identify your account information within a reasonable time, unless we need to keep it to meet a legal obligation or resolve a dispute. Providers may still hold the booking information they received, as explained in their own privacy notices.

15. General

Confidentiality. If we share information with you that is marked as confidential, or that a reasonable person would regard as confidential, you must use it only for the purposes of these terms and you must not disclose it unless the law requires. This continues to apply after these terms end.

Events outside our control. We are not liable for any failure to meet these terms caused by circumstances reasonably beyond our control, such as natural disasters, epidemics, war, government action, widespread communications failures or power outages. In those situations we will do what we reasonably can to limit the impact and resume normal service as soon as possible.

Transfer. You may not transfer your rights under these terms without our agreement. We may transfer our rights and obligations to another Enrolmy company or to a buyer of our business, and we will let you know if we do.

If part of these terms cannot be enforced. The remainder of these terms will still apply, and the affected provision will apply as far as the law allows.

Notices. Formal notices to us should be sent through our Contact us page. We may send notices to you at the email address linked to your account, or through the platform.

Entire agreement. These terms, together with our privacy policy, make up the agreement for using the platform. A provider's own terms with you are a separate agreement between you and that provider.

Terms for Activity Providers

These terms apply when you register, log in or use an organisation account. "Provider" and "you" mean that organisation and the staff you invite into your organisation account. The people who attend your activities are your customers.

CanadaEnrolmy UK & EU LimitedSee "Information for your region"

The person accepting these terms confirms that they are agreeing to them on behalf of the organisation. Where a provision in "Information for your region", at the end of these terms, differs from the rest of these terms, that regional provision applies to providers in that region.

2. What Enrolmy does

Enrolmy is a platform Providers use it to promote and manage their activities and bookings from Parents and Caregivers

You are responsible for running your activities, including the programme, venue, staff, the care of children, and pricing. Enrolmy does not deliver activities, and a family's booking with you does not make us the childcare provider, school, club or coach.

3. Agreeing to these terms, and changes

You agree to these terms by confirming your acceptance in the platform, for example by ticking the box when we ask you to. We ask you to do this when you register your organisation or create your account.

We may update these terms from time to time. When we do, the platform will prompt you to confirm the updated terms electronically the next time you use Enrolmy. The updated terms apply once you have confirmed.

If you do not wish to accept the updated terms, you can choose not to confirm, and by doing so close your account. Any obligations that already exist, such as payments due or owing, remain in effect.

4. Your account and your staff

You may use the platform for your organisation while your account is open and your fees are paid. This does not give you exclusive rights, and other providers, including those offering similar activities, may also use Enrolmy. You agree to use it only for genuine activities that you are entitled to offer.

You control staff access to your organisation account. Please make sure your team keeps their login details secure, and remove access promptly when someone leaves. Let us know promptly if you believe someone has used your account without permission.

Logins must not be shared between staff, as this is not good practice, and you remain responsible for anything done using them.

You are responsible for the staff and contractors who use Enrolmy on your behalf, and any breach of these terms by them is treated as a breach by you. Please make sure the information you give us is accurate and kept up to date.

5. Using Enrolmy responsibly

Enrolmy is designed for listing and running activities, and for the administration that goes with them. Please use it only for those purposes.

You and your staff may use the Enrolmy mobile app, and any other software we provide, while your account remains open. These form part of the platform, and these terms apply to them. The app store you download the app from may also have its own terms.

6. The platform

We use considerable efforts to keep the platform available. You will need a reliable internet connection and suitable devices to use it.

We cannot promise uninterrupted service. Section 7 explains the refund available when the platform is continuously unavailable for more than 12 hours through Enrolmy's fault.

We are always working to improve Enrolmy, so features may change over time, and occasionally a feature may be withdrawn. We make every effort to minimise the impact of changes and, where we can, introduce them with options so you can choose what works best for your organisation. Sometimes, however, a change is needed. If a change does not work for you, please let us know. You can also end your account as described in section 17.

You retain ownership of your data, but all intellectual property in the Enrolmy platform, including the website, the mobile app, our software, our branding and our documentation, remains with Enrolmy.

7. Fees

You agree to pay the fees for the plan or proposal we have agreed with you.

Active Attendees. Your plan is based on Active Attendees. An Active Attendee is anyone with at least one booking with you in a rolling six-month period, and each person is counted only once in that period. The number included in your plan is shown on your pricing plan or proposal and within the product. There is no limit on the number of staff users.

If your Active Attendees regularly exceed your plan's limit, we will move you to the plan with the next Active Attendee limit, or agree an updated fee with you.

Invoices. We invoice fees monthly, and they are due on the invoice date. If you believe an invoice is incorrect, please let us know promptly and we will correct any genuine error. Payment by a method other than card may incur an administration fee.

Fee changes. We may change our fees by giving you written notice. Any change takes effect 30 days after that notice, unless we agree otherwise.

Late payment. We may charge interest on overdue fees at 2.5% per month from the due date until payment is made.

If fees remain unpaid, or you are not meeting your obligations under these terms, we may suspend your access to the platform after giving 5 business days' written notice. Access will be restored once the overdue fees, interest and reasonable enforcement costs have been paid.

Outage refund. If the platform is continuously unavailable for more than 12 hours through Enrolmy's fault, you may request a refund of that month's fees, calculated pro rata for the period it was unavailable.

Refund: Fees already paid are not refunded when an account ends.

8. Your customers' payments

You can invoice your customers through the platform. Those invoices are issued by you, and collecting payment from families is your responsibility. We do not guarantee that a family will pay.

Tax, subsidies, funding claims and your own accounting remain your responsibility. We may offer tools to help you record them, but using those tools does not transfer any legal obligation to us.

Card payments are processed by Stripe under the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together, the "Stripe Services Agreement"). By using card payments on Enrolmy, you agree to the Stripe Services Agreement, as updated by Stripe from time to time.

You agree to give us accurate information about yourself and your organisation, and you authorise us to share that information, along with your transaction information, with Stripe so it can provide payment processing.

9. Your listings and your terms with families

You commit to offering only legitimate activities, and to offering bookings, in good faith, for activities you will run. Families rely on your listings, so please keep your activity details, prices, dates and policies accurate and up to date.

Your terms are shown to families on your booking pages. Please make sure they set out the price, what is included, and your cancellation and refund policy, so families can read them before they commit to pay.

Your contract is with the family. Your terms must not suggest that Enrolmy provides the activity, or that claims about the activity should be made against Enrolmy.

Where the law requires a platform to display certain details about the business offering a service, you agree to provide those details and keep them accurate, including your legal name and a means of contact.

You must not upload content you do not have the right to use.

10. Safety, checks and insurance

You are responsible for the safety of your activities. This includes supervision, staffing, qualifications, venues, and any police, vetting or safeguarding checks that apply to your work and region.

You are also responsible for holding the insurance that a careful operator of your type of activity would hold.

We may suspend a listing or an organisation account if we reasonably believe an activity poses a serious safety risk, or if the law requires us to. Where it is reasonable to do so, we will let you know.

11. Your data

The data you and your customers submit to your account, subject to privacy regulation considerations, belongs to you, including attendance, booking and programme records. While your organisation account is open, you can export a copy at any time, for example as a file or, if your plan includes it, through a programmatic interface such as an API. Once you have asked Enrolmy to supply your data by your chosen method, you are responsible for looking after that data appropriately, including any personal information it contains, and for complying with the privacy legislation that applies to you.

You give us a licence to store, back up and use that data so we can provide the platform to you and your customers and meet our legal obligations. This licence lasts for as long as we need the data for those purposes and does not transfer ownership.

We may use data, including public programme content and data across our customer base, to compile anonymised industry statistics and reports that do not identify any individual or organisation. We may share those statistics.

We use considerable efforts to keep data secure. However, no internet transmission is completely secure, and we cannot guarantee that it will be.

If you connect a third-party tool to your account, you are authorising its supplier to access the data needed to run it. The supplier's own terms apply to that tool, and to the security and treatment of your data once it has left Enrolmy. Your own terms should explain to families how you use their data, and Enrolmy has a number of tools to help you do this.

12. How we handle personal information on your behalf

This section covers personal information about families, participants and your staff that we process on your behalf so you can run your activities. You decide how that information is used, and we process it for you.

Regarding your Enrolmy organisation account, our platform, and our own relationship with you, please refer to our privacy policy.

When we process personal information on your behalf, we will:

  • act on your instructions, which are these terms, the way you set up and use the product, and any reasonable written instructions you give us. If the law requires otherwise, we will tell you, unless the law prevents us from doing so.
  • ensure that anyone handling the information is bound to keep it confidential
  • protect it with security measures appropriate to the information, including children's and health information
  • use other processors only where needed to run the platform, such as hosting, email and payment services. Our privacy policy lists the categories, and we will provide the current list of suppliers on request. We remain responsible for their processing under this section.
  • help you respond to requests from individuals to access, correct or delete their information, as far as the platform allows
  • notify you without undue delay if we become aware of a personal data breach affecting your information, and help you meet your own notification obligations
  • delete or return the information when the service ends, as described in section 17, unless the law requires us to keep it
  • provide the information you reasonably need to confirm that we are meeting the commitments in this section

In turn, you agree to:

  • have a valid reason for collecting and using the information, and explain this to families in your own privacy notice
  • collect children's information only with the authority of a parent or guardian, or on another lawful basis
  • limit health and other sensitive information to what you need to care for participants
  • not ask us to do anything with the information that would breach privacy law

13. Confidentiality

If either of us receives information from the other that is marked as confidential, or that a reasonable person would regard as confidential, the recipient will:

  • use it only for the purposes of these terms
  • not disclose it, other than to staff, contractors and advisers who need it and are required to keep it confidential, or where the law requires

This includes our non-public business information and your non-public programme material. It does not include information that is already public, that the recipient already knew, or that the recipient obtains from someone else who was free to share it.

Information you publish in a listing is not confidential, as the purpose of a listing is to share it.

This section continues to apply after these terms end.

14. Your content

You keep ownership of the content you submit, such as listings, images and programme material. You give us a licence to host and display it so we can provide the platform and promote your activities to families.

15. Liability

This section explains what we are, and are not, responsible for, so please read it carefully.

Your activities. You are responsible for your activities and the fees you charge. Enrolmy is not responsible for running the activity, safety at the venue, staff, the care of children, or for whether a family pays you.

The platform. We provide the platform with reasonable care and skill, but we cannot guarantee that it will be free of errors or always available. We are not liable for loss caused by a failure of the public internet or of your own equipment.

Limits. As far as the law allows, we are not liable for loss of profit, loss of business, or any other indirect or consequential loss arising from your use of the platform.

You will not bring Enrolmy into disrepute. If you have a dispute about our relationship, you will raise it with Enrolmy directly, and we will each engage in good faith to resolve it before either of us takes the matter further.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded under the law that applies to you.

These limits also apply to our directors, staff and contractors.

16. Responsibility for loss you cause

You agree to cover reasonable losses, costs and claims we incur because of your activities, your listings, your terms with families, personal information you were not entitled to upload, or your breach of these terms.

This applies only to loss that results from that conduct. It is not a general promise to cover every issue connected with Enrolmy, and it does not extend to loss that we cause ourselves.

17. Ending your account

You can end your account by contacting us in writing through our Contact us page, or by using a close-account option in the product where one is available. Your notice takes effect a minimum of 30 days after we receive it, unless we agree a different date.

We may end your account without cause by giving 30 days' written notice, or suspend it for overdue fees under section 7. We may also suspend or end it immediately if:

  • you seriously breach these terms, or you breach them and do not put things right within a reasonable time after we ask you to
  • you become insolvent, stop trading, or have a receiver, liquidator or administrator appointed, other than as part of a solvent restructure we have agreed to
  • you do something that causes serious harm to the platform or to our reputation

When your account ends:

  • you must stop using the platform and return or delete any of our confidential information
  • any fees already due become payable
  • fees already paid are not refunded, other than an outage refund under section 7
  • you have 30 days to export your data. After that, we will delete or de-identify it, unless the law requires us to keep it or we need it to resolve a dispute. Provided we have told you that your account is ending, we are not liable for data deleted after that period.

Bookings that families have already made remain yours to honour or resolve with them under your own terms. Ending your Enrolmy account does not release you from those commitments, and it does not affect rights that already exist.

18. General

These terms, together with our privacy policy and any plan or proposal we agree with you, make up the agreement for using the platform. Your own terms with a family are a separate agreement between you and that family.

Information for your region

These terms are the same everywhere. This section sets out, for each region, the Enrolmy company you contract with, the law that applies, and the consumer rights that cannot be excluded.

New ZealandYour region

You contract exclusively with Enrolmy Limited. These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.

If you are a consumer, nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. It continues to apply, as the Act requires, to a family's booking.

AustraliaYour region

You contract exclusively with Enrolmy AU Pty Ltd. These terms are governed by the laws of Australia and of the state or territory where you ordinarily live, and the courts of that state or territory have jurisdiction.

Nothing in these terms excludes, restricts or modifies any right under the Australian Consumer Law that cannot lawfully be excluded. Where the law allows a guarantee to be limited, and the platform is not of a kind ordinarily acquired for personal or household use, our liability for breaching that guarantee is limited to supplying the service again or paying the cost of doing so. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts and keep any mandatory protections of the law where you live.

If you are a consumer, nothing in these terms affects your rights under the Consumer Rights Act 2015. Providers use the platform as business customers, so the consumer remedies in that Act do not apply to a provider's use of the platform. Any term the law treats as unfair will not be applied.

Ireland and the rest of the EU/EEAYour region

You contract exclusively with Enrolmy UK & EU Limited. For users in Ireland, these terms are governed by Irish law, and the Irish courts have jurisdiction. If you are a consumer, you also keep the mandatory protections of EU consumer law and of the country where you live.

Nothing in these terms affects your rights as a consumer under the Consumer Rights Act 2022 or EU consumer law. Providers use the platform as business customers.

United StatesYour region

You contract exclusively with Enrolmy UK & EU Limited, unless we agree a different Enrolmy company with you.

These terms do not affect any rights you cannot waive under the law of the US state where you live, including consumer protection laws. We do not require you to arbitrate disputes or to waive class actions.

SingaporeYour region

You contract exclusively with Enrolmy Limited. These terms are governed by Singapore law, and the Singapore courts have jurisdiction.

Nothing in these terms excludes any right under the Consumer Protection (Fair Trading) Act 2003 that cannot lawfully be excluded. The Personal Data Protection Act 2012 is addressed in our privacy policy.

You contract exclusively with Enrolmy UK & EU Limited. These terms are governed by the laws of the province or territory where you ordinarily live, and the courts of that province or territory have jurisdiction.

Nothing in these terms excludes any consumer right that the law of your province or territory does not allow a business to exclude. Privacy matters, including PIPEDA and provincial privacy law, are addressed in our privacy policy.

Other countries

If you are in a country not listed above, you contract exclusively with Enrolmy Limited, and New Zealand law and the New Zealand courts apply. You keep any mandatory consumer protections of the country where you live.
