WARNING: This is a legal document that affects your rights, if you are uncertain or uncomfortable with some of the conditions of registration then we recommend that you obtain advice to ensure you understand and accept the conditions of entry. I agree that my child/children/I/enrolled member can participate in these services conducted by Ben Jones (T/A What's that Racquet) and events on the following basis;

 

1) Group & Private lesson Bookings

Wet Weather

Wet weather cancellation notifications will be delivered by Text (SMS) or Whattsapp message as early as possible by our office. Unfortunately we are unable to provide make up sessions to customer who assume lessons are cancelled due to wet weather. If you have not received a text message or contact from the coach they have deemed the court to be safe and the lessons will proceed. As a courtesy customers will be eligible for make sessions for all wet weather cancellations. Please see our makeup lesson policy below. Holiday camps are always on, if there is a probability of less than 3 hours of outdoor play a credit will be offered. No cancellations on predicted weather will be accepted.

 

Cancellations

Cancellations must be communicated to What's that Racquet 24 hours prior to the commencement of the class. Customers who fail to notify What's that Racquet by email or phone call are ineligible for make-up sessions. Please be aware make up sessions are subject to availability only and must be completed within the same term. In the event that you cancel your booking, What's that Racquet also reserves the right to charge a cancellation fee as follows:

 

Bookings cancelled within 24 hours of your booking: 100% of the value of the booking.

Bookings cancelled with greater than 24 hours notice: up to 50% of the value of the booking

Make-up Sessions

What's that Racquet offers make-up sessions as a courtesy for customers affected by wet weather and communicated cancellations for approved cancellations only. This must be communicated via email and What's that Racquet reserves the right to at their discretion offer (/not offer) a make up session for the cancellation. Make up sessions must be booked in advance and used within the same term. Make up sessions are also subject to availability only.

 

Refund & Credit

All refund requests will be reviewed on a case by case basis. What's that Racquet reserves the right to issue account credits to a customer account in lieu of a cash refund.

Free Trials are a paid trial if the player can’t commit to the term after the date of the first trial

 

Payment Recovery & Costs

 

In the event a client fails to pay for services rendered by What's that Racquet and/or have booked in for without payment, the debtor/s shall pay for all costs incurred by What's that Racquet in the recovery of any monies owed, as well as the amount owed. Under this agreement, costs of recovery include recovery agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis. We reserve the right to take legal action to recover owed monies and outsource the debt to an external debt collecting agency.

 

Injury Credit Policy

Customers who are injured and unable to participate in sport will receive a credit for their missed sessions. Credits must be used the following tennis term. Alternatively the remaining sessions can be transferred to a family member or friend. All injuries must be accompanied with a valid medical certificate covering date/s of the program/s missed.

 

Discounts and Promotions

Free trials are offered by What's that Racquet for group classes only. These trials are strictly for new members only, one per customer and are subject to availability.

 

All discounts on programs are subject to payment in full prior to the program commencing. All promotions and discounts are only valid before due date.

 

Membership

Court hire is subject to court availability and is based on pro-rata calendar year. Bookings are to be made in advance and online. Discounts on strings and grips are subject to stock.

 

You agree to accept membership with Inspire Tennis, Northern Suburbs Tennis Association, Tennis New South Wales and Tennis Australia.

 

Payment Terms for All Bookings

a) Whats that Racquet online payments are processed and encrypted by commonwealth bank

 

b) Online payments will be processed in full at the completion of the order. Clients can register and make payment for the programs up to 60 days before commencing the program.

 

c) Late payment: Customers who fail to pay their account before commencement of the program will be subject to a late payment fee of 4%. Overdue accounts of over 30 days will incur an additional 4% late payment fee.

 

d) Time to delivery: Bookings will be confirmed at the completion of the online order by payment.

 

e) If you cannot process payment from your computer or mobile device, see a manager and pay online at our head office (Northbridge) or contact us to pay over the phone.

 

f) By enrolling in a program (ie. online, over the phone or in person) you acknowledge and agree to all Terms and Conditions set out in this document.

 

Bookings Non-Transferrable

My service registration is not transferable to other people or other event. Any attempt to transfer my entry or allow another person to participate under my name without the Directors knowledge may result in total cancellation without refund, insurance being deemed void and inability to enter further services or events.

 

Competitions

You agree to abide by Whats that Racquet, Northbridge Tennis Club and Tennis Australia competition rules, etiquette, term and conditions

 

Awards

You agree to accept that rewards and prizes such as ice blocks, sweets, lollies, toys, merchandise, soft drinks or chips may be given to the participant.

 

Booking Rights

You warrant that:

 

a) all personal details provided are true and accurate;

 

b) you have all necessary rights as a student, parent or guardian to grant the rights;

 

c) Information is not obscene or defamatory;

 

d) You will indemnify What's that Racquet against any loss or damage resulting from any breach of these warranties.

 

e) You acknowledge that What's that Racquet is under no obligation to exercise any of the rights

 

f) I certify that I am a student/parent/legal guardian/entrant and I have read this document and understand and accept the terms and conditions it contains.

 

Supervision

I agree that What's that Racquet is not responsible for supervision of my child/ren before or after the session has commenced/finished.

 

Consent to Use Image

In consideration of my participation in tennis programs or camp, I agree to What's that Racquet taking and retaining and reproducing the registered applicants image or likeness obtained during my (their) participation in tennis programs in photographs, electronic images, sound recording, clips and video footage placed on our website, social marketing associations or brochures media without notice and without any fee being paid to you, for the purpose of What's that Racquet promotional, advertising, research or marketing materials.

 

Consent to venue changes

 

I agree that venue changes can occur due to scheduling arrangements.

 

Holiday Programs

Wet Weather Policy

Holiday camp will proceed Rain, Hail, or Shine.

 

Cancellations

Cancellations must be communicated to What's that Racquet 48 hours prior to the commencement of the booking. Customers who fail to notify What's that Racquet are ineligible for make-up sessions. Make up sessions during holiday camp are due to availability only and must be completed during the same holiday camp period.

 

Make-up Sessions

 

What's that Racquet offers make-up sessions as a courtesy for customers during holiday camps for approved cancellations only. This must be communicated via email and What's that Racquet reserves the right to at their discretion offer (/not offer) a make up session for the cancellation. Make up sessions must be booked in advance and used within the same camp. Make up sessions are also subject to availability only.

 

Credit Policy

Refund policy: All refund requests will be reviewed on a case by case basis. What's that Racquet reserves the right to issue account credits to a customer account in lieu of a cash refund.

 

Refunds or credits will not be issued due to weather, or failing to turn up and are subject to availability only.

 

Excursions

I give permission for my child/children/I/enrolled member when registered in our coaching services, camp or competitions to participate or be involved in: shuttle bus transportation where needed, strike bowling and laser tag entry, ten pin bowling, movie excursions, ice skating, inter-club challenges, swimming and all affiliated excursions at tennis camps.

 

Extra Supervision

This must be booked on our website. If your child is away or does not need this service we must be notified. All extra supervision enrolments are non-refundable.

2) Safety and Medical

Medical

Entrants authorise Whats that Racquet to obtain medical assistance, treatment and transport as deemed reasonably necessary by What's that Racquet and acknowledge that they will be responsible for any costs associated with any such medical treatment and/or transportation.

 

I understand that I/my child/children should not participate in this event/events unless responsible, educated and social and in a fit state to complete the event safely. I acknowledge that if I am aware of an existing medical condition and uncertain of my state of fitness then a medical practitioner should verify my physical condition.

 

I have provided or attached to my entry form details of any medical or physical conditions from which I suffer that might affect my performance or be relevant if medical treatment is needed. I accept the risk of participating despite these conditions. I have supplied an emergency contact name and number, this person is contactable both during and after the event and is not another participant.

 

All participants must be toilet trained or otherwise accompanied by an adult/parent or superviser.

 

Suppliers

What's that Racquet has no liability for any act, omission or default, whether negligent or otherwise of any supplier. We have no liability for any loss or damage occasioned by the negligence, act or omission of any supplier or other third party. In circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements.

 

Your Coach

a) Is insured under GIO General Ltd Workers Compensation

 

b) Has completed a police check for the NSW commission, child related working with children and young people

 

Insurance

a) You, your child/children are insured with Public Liability, Products Liability, property damage and Professional Indemnity under Tennis Australia underwriter Sportcover Australia Pty Ltd.

 

b) I understand that insurance cover in our coaching services may not cover me for all injury, loss or damage sustained by me. Whats that Racquet Is not liable for any damages. Your child participates at their own risk

 

3) Transport

Bus Service

I give permission for my child/children/I/enrolled member when registered in our coaching services, camp or competitions to participate or be involved in: shuttle bus transportation where needed, strike bowling and laser tag entry, ten pin bowling, movie excursions, ice skating, inter-club challenges, swimming and all affiliated excursions at tennis camps throughout term coaching, school sport classes, private lessons or special events. You consent to you child/ren being transferred either to or from the program venue, organised by our trusted transport partner.

 

Bus Bookings

This must be booked in advance in your account. If the child/ren is/are absent we must be notified in advance. Failure to contact us once there is a warning, twice and your child may be removed from the bus service and an additional fee of $50 may be incurred.

 

Walk

If the program enrolled in requires transport by foot, you consent to your child/ren being transferred by Inspire Tennis to their school, either before or after school and vice versa which may include crossing roads.

 

4) Property and Entry

Security Cameras

Security cameras operate within some Whats that Racquet centres/venues/facilities. Entrants acknowledge that they may be filmed.

 

Conditions of Entry

Entrants must behave appropriately and follow the lawful directions of What's that Racquet at all times. Derogative comments, abusive language and inappropriate or disruptive behaviour will not be tolerated.

 

Whats that Racquet reserves the right to refuse entry to any person or remove any person from its tennis centres/venues/facilities.

 

Damage

If an entrant causes any damage to What;s that Racquet property/facilities/equipment they will be held responsible for all costs associated with replacement or repairs whichever is decided by What's that Racquet.

 

Personal Property

Entrants are responsible for their own property at all times. What's that Racquet does not accept any responsibility for any property that is stolen, lost or damaged in the Whats that Racquet centres/venues/facilities.

 

Authorised Tennis Coaches

Only authorised Inspire Tennis coaches are permitted to provide tennis coaching or lessons at Whats that Racquet centres/venues/facilities. This includes the use of coaching baskets or other coaching equipment on court. Entrants must not receive any tennis coaching or lessons at Whats that Racquet centres/venues/facilities.

 

The use of cameras and other photographic or recording equipment (including mobile phones) at What's that Racquet centres/venues/facilities is not permitted without Whats that Racquet prior written consent.

 

5) Declaration, Waiver and Indemnity

Release and Indemnity

I acknowledge that coaching, competitions, camps and all other events conducted by What's that Racquet, expose my child/children/I/enrolled member to certain risks when using the facilities, including but not limited to physical injury and death, psychological abuse or permanent injury, arising from various causes such as overexertion, equipment, food consumption, transport, dehydration, accidents with other competitors, spectators or road users, weather conditions and other causes. All entrants enter Whats that Racquet programs at various centres/venues/facilities at their own risk.

 

In consideration of the applicants participation in Whats that Racquet programs, I agree to release, defend, hold harmless and indemnify What's that Racquet and its directors, officers, employees, and volunteers from any actions, claims, demands, expenses howsoever arising from any injury, loss or damage incurred in connection with my participation in Whats that Racquet programs. This release shall extend to and include Northbridge Tennis Club, Tyneside courts, Willoughby, Primrose Tennis Club, Tennis New South Wales and Tennis Australia, event organizers and their respective directors, partners, managers, officers, agents, contractors, employees and volunteers including event medical and paramedical personnel. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.

 

6) Privacy Policy
